Augmented reality browser Junaio offers less 'clunky' apps, new API for developers

Remember Metaio? Back in February we reported on the company's rather neat brand of markerless augmented reality, and now it has some fresh news: a major revamp to its Junaio AR browser for iOS and Android, which incorporates the markerless algorithms and a lot more besides. The browser is an open platform for a myriad of smaller AR apps coded by independent developers, and the new version includes both a new UI and API to give those devs additional tools in HTML5 and JavaScript.

Right now, the app is worth a peek for the various curiosities demo'd after the break -- such as the ability to see other people's Instagram photos overlaid on the view from your rear camera, showing the direction and distance to the point where they were snapped. In time, though, we're really hoping that developers will latch on to platforms like this and take AR to where it needs to be: something that let's us recognize and augment people and objects naturally and instantaneously, without pre-conceived markers. In fact, Junaio really needs to have coffee with Project Glass.

Update: looks like the Android version has jammed in a pipe somewhere and won't hit Google Play til June 25th.

'Abraham Lincoln: Vampire Hunter' Cast Share Slo-Mo Acting Tips

Working with a director like Timur Bekmambetov guarantees a few things. You'll probably take part in some insane action sequences. And there will definitely be slow-motion.

When MTV News sat down with Benjamin Walker and Anthony Mackie, from Bekmambetov's latest film, "Abraham Lincoln: Vampire Hunter," they shared some helpful hints about how to properly act in super-slo-mo.

"Don't think about it," Walker said right off the bat. He probably had the most to do at the slow speed as our 16th president and first commander in vampire slaying, Abraham Lincoln.

But it's never that simple, as Mackie was able to attest. "Be willing to look stupid," he warned.

The final sequence of the film finds Abe and his best friend, Will Johnson (Mackie), atop a locomotive, riding along a burning bridge. It required a lot of slow-motion running and jumping. Mackie couldn't help but exaggerate his movement as he leapt from car to car.

"There's that whole sequence where we're jumping from one car to the other when the bridge is burning up, and I literally couldn't stop doing the 'swim' move when I was jumping. So Timur was like, 'Don't do the swim move,' and I was like, 'Sh--,' " he said. "So we're on the train, and he's like, 'Don't think about it,' and I'm like, 'All right, all right, all right.' Action, jump, swim. In order not to do the swim move, I do a shot-put move. Needless to say, I'm glad it looked all right in the movie, because I thought I was going to look like an idiot."

Similarly, during something as simple as a ballroom-dancing scene, Walker couldn't help act out the slo-mo. "When we were shooting the ballroom scene, it was in slow motion," he said. "I knew it in my mind, so I start kind of slowing down. He goes, 'No, stop. We'll slow it down later.' "

But if it came down to it, Mackie had one big piece of advice. "It's all about your face," he said. "They always say, 'Be careful about your face.' "

Defense abruptly rests without calling Jerry Sandusky

Jerry Sandusky was expected to take the stand Wednesday, but his defense team ? who suggested that Sandusky's accusers were motivated by money ? had a different strategy. NBC News' John Yang reports from Bellefonte, Pa.

Updated at 6:55 p.m ET: Lawyers for Jerry Sandusky abruptly rested their case Wednesday morning without calling the former Penn State University assistant football coach to the stand.

It was an unexpected end to the defense phase of Sandusky's trial on 51 counts alleging that he abused 10 boys over 15 years.

Without explanation, defense attorneys requested a recess during testimony from one of their own witnesses. Then ? after an unusually long break during ,which both legal teams joined the judge in his chambers amid speculation over whether Sandusky would take the risky step of testifying ? defense attorneys said they were done.

The prosecution offered no rebuttal witnesses. Court was adjourned until Thursday morning, when closing arguments were scheduled.

The defense decision came after the witness, David Hilton, 21, reacted with surprise when he was asked whether he knew that his uncle had called the defense team Tuesday night. Sandusky attorney Karl Rominger then asked for a recess.

Hilton was testifying that he spent a lot of time with Sandusky as a youth. He said he spent many nights at the Sanduskys' home but that nothing inappropriate ever happened.

It wasn't the only surprise on the seventh day of Sandusky's trial in Bellefonte, Pa. Judge John Cleland announced as court opened that one of the jurors had taken ill and was being replaced by an alternate.

Then, he announced that lawyers for both sides had agreed to stipulate that the Pulitzer Prize-winning journalist who broke the Sandusky story had helped the mother of one of Sandusky's alleged victims find an investigator.?The defense contends that investigators and journalists in Pennsylvania started with the premise that Sandusky was guilty of abusing young boys and ignored evidence of his innocence.

The reporter, Sara Ganim of the Harrisburg Patriot-News, who broke the news that a grand jury was investigating Sandusky, was called under subpoena by the defense. The newspaper sought to quash the subpoena, citing Ganim's right to protect her sources, but Cleland turned down the motion.

After a conference at the bench at which lawyers for the newspaper sought to keep her off the stand, Cleland told jurors that Ganim had been called to answer questions about whether, "prior to charges being filed in the case, she contacted the mother of an alleged victim and provided her with contact information for an investigator in this case."

Cleland said the legal teams had stipulated that "the answer would be yes."

Ganim remained in the courtroom, where she could be heard vigorously disagreeing with the stipulation agreement between the prosecution and defense teams.

Ganim later told her newspaper: "For the record, I would not have answered yes to that question. I would have declined to comment under the Pennsylvania Shield Law.''

The revelation that Ganim ? who won widespread acclaim and journalism's highest honor for her pursuit of the Sandusky allegations ? may have interjected herself into the story as a participant goes to the heart of one of the defense's primary arguments: that Sandusky was being steamrollered by institutional forces oblivious to evidence that he might not be guilty.

"There are a lot of forces at work pushing this forward," Sandusky attorney Joseph?Amendola told Cleland during the subpoena arguments Tuesday.

The defense has already demonstrated, through testimony and audio of a police interview with one of the alleged victims, that investigators at times told potential witnesses that there were other victims in the case, which the defense contends tainted their testimony.

Jurors also heard from Jonathan Dranov, a friend of the family of Michael McQueary, the former Penn State assistant coach who testified last week that he saw Sandusky in a football locker room shower with a young boy.

McQueary testified said he didn't explicitly see any intercourse, but he said he had "no doubt" that it was occurring because of the relative positions of Sandusky and the boy and the sounds they were making.

Dranov said he was present at a conversation at which McQueary recounted the alleged incident, concurring that McQueary didn't describe having directly seen any sex act.

"I kept saying, ?What did you see?'" Dranov testified. "Each time, he would come back to the sounds. It just seemed to make him more upset, so I backed off that."

What do trademark infringement attorneys dream of when they take a little tiger snooze?? Sometimes it is an interesting trademark infringement case that deals with a wildly popular movie, a famous fashion company and some fundamentals in trademark law.? Just such a case recently issued an opinion that has many good instructional points in trademark infringement law.? See Louis Vuitton Mallatier S.A. v. Warner Brothers Entertainment Inc., Cause No. 11 Civ. 9436 in the United States District Court for the Southern District of New York (?Hangover II ?).?

This trademark infringement case involved the use of Louis Vuitton?s trademarks in the movie ?The Hangover: Part II.? For those familiar with the Hangover movies and characters, you will know that the character Alan deflects criticism in the first movie of his man purse by calling it a ?satchel? and grouping himself in the esteemed company of Indiana Jones.? In the Hangover II, the gags continue with Alan and the ?wolf pack? riffing on a fake Louis Vuitton Keepall travel bag.?

The court trademark infringement opinion is both entertaining and instructive.? The opinion even references lines in the movie.? Alan states that, with respect to a counterfeit Louis Vuitton Keepall travel bag, to be ?careful that is? . . . that is a Lewis Vuitton.?? ?Louis Vuitton did not see the humor in the line or the use of the fake bag and filed a lawsuit against Warner Bros. asserting three claims for relief (1) false designation of origin/unfair competition in violation of Section 43(a) of the Lanham Act (i.e. trademark infringement); (2) common law unfair competition; and (3) trademark dilution in violation of N.Y. Gen. Bus. Law 360-l.?

On June 15, 2012 the Court sided with Warner Bros. and dismissed the lawsuit for failure to state a claim upon which relief can be granted.?

Louis Vuitton complained that Warner Bros. misrepresented that the knock off bag was a genuine Louis Vuitton product. More specifically, Louis Vuitton argued that Warner Bros. impressmissably used a third-party?s bag that allegedly infringed on the Louis Vuitton trademarks.? In reviewing Louis Vuitton?s Lanham Act claims the court noted that the Lanham Act is inapplicable to ?artistic works? as long as the defendant?s use of the mark is (1) ?artistically relevant? to the work and (2) not ?explicating misleading? as to the source or content of the work.? Rogers v. Grimaldi, 875 F.2d 994, 999(2d Cir. 1989).? In examining the artistic relevance issue, the court noted that the remark came ?across as funny because [the character] mispronounces the French ?Louis? like the English ?Lewis.?"? The court concluded that the use of the knock-off bag had some artistic relevance to the plot of the Hangover: Part II.? The court also concluded that the allegations of confusion were not plausible and that there was no likelihood of confusion that viewers would believe that the fake bag was a real Louis Vuitton bag just because a fictional character made this claim in the context of a fictional movie.? ??While humor rarely translates to written legal opinions, it cannot be said that the United States District Court for the Southern District of New York does not recognize a humorous scene in a movie when it is asked to review it in a trademark infringement claim.? This opinion, while entertaining, also highlights the current state of the law on the applicability of trademark infringement to ?artistic works.?
